Plain Language Summary: Always There For You is a family caregiving coordination app with free and premium tiers. By using it, you agree to be kind to others, keep your account secure, use the app responsibly, and follow the rules below. You own the content you create. We provide the service as-is and do our best to keep it running smoothly. Nothing in these Terms affects your statutory rights as a consumer under UK law.

1. Agreement to Terms

By creating an account or using the Always There For You mobile application or web platform (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yak Development Ltd (trading as Always There For You) regarding your use of the App.

2. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

We reserve the right to request verification of age or parental consent at any time and to suspend accounts that do not meet these requirements.

3. Account Registration and Security

To use the App, you must create an account using a valid email address. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

You are the sole authorised user of your account. Sharing account credentials with others is prohibited. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

4. Description of Service

Always There For You is a mobile and web application designed to help families and carers coordinate care for their loved ones. The App provides features including, but not limited to:

  • Family Circles: Create or join groups of up to 10 members to coordinate care
  • Messaging: Send text messages and voice notes within your Family Circle
  • Care Requests: Create, accept, and track help requests for loved ones
  • Shared Calendar: Schedule and manage events, appointments, and recurring tasks
  • Emergency Contacts: Store and quickly access important contact information
  • Notifications: Receive alerts for messages, care requests, calendar events, and reminders
  • Message Templates: Use pre-written messages for common caregiving communications

The App supports two user roles:

  • Loved Ones: Individuals receiving care, with a simplified, accessible interface
  • Angels: Family carers who coordinate and provide care, with a full-featured interface

5. Acceptable Use

You agree to use the App only for its intended purpose of family caregiving coordination. You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Harass, abuse, threaten, or intimidate other users
  • Send spam, unsolicited messages, or promotional content through the App
  • Impersonate another person or create a false identity
  • Attempt to gain unauthorised access to other users' accounts or data
  • Upload or transmit viruses, malware, or any other malicious code
  • Interfere with or disrupt the App's functionality or infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use the App for commercial purposes without our prior written consent
  • Scrape, harvest, or collect information about other users without their consent
  • Use automated systems (bots, scrapers, etc.) to access or interact with the App

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending accounts, or reporting to the relevant authorities.

6. User Content

Your Content

You retain ownership of all content you create and share through the App, including messages, voice notes, care requests, calendar events, and profile information (“User Content”).

By posting User Content, you grant Always There For You a limited, non-exclusive, royalty-free licence to use, store, transmit, and display your content solely for the purpose of providing and improving the App. This licence ends when you delete your content or your account.

Content Within Family Circles

Content you share within a Family Circle is visible to all members of that Family Circle. You are responsible for ensuring that you have the right to share any information you post, and that you have obtained any necessary consent from individuals whose information you include (such as emergency contacts or care-related details).

Prohibited Content

You may not post content that:

  • Is illegal, defamatory, threatening, or harassing
  • Infringes on the intellectual property rights of others
  • Contains personal information about others without their consent
  • Is fraudulent or misleading
  • Promotes violence, discrimination, or hatred

7. Important Disclaimers

Not a Medical Service

Always There For You is a coordination and communication tool only. The App is not a medical service, healthcare provider, or emergency response system.

Specifically:

  • The App does not provide medical advice, diagnoses, or treatment recommendations
  • The App allows you to store health profiles, symptom logs, and care plans within your Family Circle to facilitate care coordination and generate AI-powered care guidance. This information is not a substitute for professional medical records.
  • AI-generated care briefs and condition insights are for informational purposes only and do not constitute medical advice. Always consult a qualified healthcare professional for medical decisions.
  • The App should not be used as a substitute for professional medical care
  • In a medical emergency, always call 999 (or 112) first
  • The emergency contact features are for convenience only and do not connect to emergency services

Not a Professional Care Service

The App facilitates coordination among family members and does not:

  • Provide professional caregiving services
  • Vet, screen, or certify any users as qualified carers
  • Guarantee the availability, reliability, or quality of care provided by other users
  • Create any employer-employee or professional-client relationship between users

Communication Limitations

Whilst we strive for reliable message delivery:

  • We do not guarantee real-time delivery of messages or notifications
  • Push notifications depend on device settings, network conditions, and third-party services (Apple Push Notification Service)
  • The App should not be relied upon as the sole means of communication for urgent or time-sensitive matters

8. Intellectual Property

Our Property

The App, including its design, code, graphics, logos, interface, and documentation, is owned by Yak Development Ltd and protected by intellectual property laws, including the Copyright, Designs and Patents Act 1988 and applicable international treaties. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

Trade Marks

“Always There For You,” the App logo, and related marks are trade marks of Yak Development Ltd. You may not use these marks without our prior written permission.

Feedback

If you provide suggestions, ideas, or feedback about the App, you grant us the right to use that feedback without restriction or compensation to you.

9. Third-Party Services

The App integrates with the following third-party services:

  • Supabase: Database, authentication, file storage, and real-time communication infrastructure
  • Apple Push Notification Service (APNs): To deliver notifications to your iOS device
  • Apple StoreKit 2: For processing in-app purchases and managing subscription status
  • Microsoft Azure OpenAI (UK-hosted): Server-side AI processing to generate personalised care briefs and condition insights. Health data is processed within the UK via Azure's UK South data centre — no personal data is retained. Microsoft does not use API data for model training.
  • TelemetryDeck: Privacy-first, opt-in anonymised usage analytics
  • iOS Calendar (EventKit): Optional integration for syncing events with your device's local calendar

These third-party services are governed by their own terms of service and privacy policies. We are not responsible for the practices or policies of third-party services.

10. Availability and Modifications

Service Availability

We strive to keep the App available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to:

  • Scheduled maintenance or updates
  • Unexpected technical issues or outages
  • Factors outside our control (network failures, third-party service disruptions)

Modifications

We reserve the right to modify, update, or discontinue any feature of the App at any time. We will make reasonable efforts to notify users of significant changes through in-app notifications or other means.

11. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under English law

Subject to the above, and to the maximum extent permitted by applicable law, Yak Development Ltd and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of data, profits, revenue, or goodwill
  • Any damages arising from your reliance on the App for medical or emergency purposes
  • Any damages resulting from unauthorised access to or alteration of your content
  • Any damages arising from interruption or cessation of the App's services
  • Any damages exceeding the amount you paid to us in the twelve (12) months preceding the claim

If you are a consumer, you have legal rights in relation to services not carried out with reasonable skill and care. Nothing in these Terms affects those statutory rights. Advice about your legal rights is available from your local Citizens Advice Bureau or Trading Standards office.

12. Warranty Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, except to the extent that such warranties cannot be excluded under applicable law.

To the fullest extent permitted by law, we specifically disclaim all implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Yak Development Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you post or share through the App

This section does not apply to the extent that a claim arises from our own negligence or breach of these Terms.

14. Termination

By You

You may stop using the App and delete your account at any time through the Settings screen within the App. Upon account deletion:

  • Your profile and personal information will be permanently removed within 30 days
  • Messages you sent within Family Circles will be removed
  • Care requests you created will be removed
  • Your membership in all Family Circles will be revoked

By Us

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe:

  • You have violated these Terms
  • Your continued access poses a risk to other users or our service
  • Your account has been inactive for an extended period
  • We are required to do so by law

Where reasonably practicable, we will give you advance notice and an opportunity to download your data before termination.

Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law.

15. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. If you are a consumer resident in Scotland, you may also bring proceedings in Scotland. If you are a consumer resident in Northern Ireland, you may also bring proceedings in Northern Ireland.

Informal Resolution

Before filing any formal legal claim, we encourage you to contact us at support@alwaysthereforyou.app so we can attempt to resolve the dispute informally. We will endeavour to respond within 14 days.

Jurisdiction

Any disputes arising from or relating to these Terms or your use of the App that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer and are entitled to bring proceedings in the courts of your country of residence.

Alternative Dispute Resolution

If you are a consumer and we are unable to resolve a dispute, you may be entitled to refer the matter to an alternative dispute resolution (ADR) provider. You can find information about ADR at the Citizens Advice website (citizensadvice.org.uk).

16. Data Protection

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use, and protect your personal data are set out in our Privacy Policy.

You have the following rights under UK data protection law:

  • The right to access your personal data
  • The right to rectification of inaccurate data
  • The right to erasure (the “right to be forgotten”)
  • The right to restrict processing
  • The right to data portability
  • The right to object to processing
  • Rights in relation to automated decision-making and profiling

To exercise any of these rights, please contact us at support@alwaysthereforyou.app. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

17. Changes to These Terms

We may modify these Terms from time to time. When we make changes:

  • We will update the “Last Updated” date at the top of these Terms
  • For significant changes, we will notify you through in-app notifications at least 30 days before the changes take effect
  • Your continued use of the App after changes take effect constitutes acceptance of the updated Terms

If you do not agree with the revised Terms, you should stop using the App and delete your account before the changes take effect.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision. Any waiver must be in writing and signed by Yak Development Ltd.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, provided that such assignment does not reduce the protections afforded to you under these Terms.
